The agreement sets out the terms of the licence for the software supplied which is later called "the software". If you do not agree to the terms of this agreement, please do not open the software package but promptly return it, together with the other items belonging to the same package as the software, to the place where you obtained it and you will be given a full refund.
You are granted a non-exclusive licence to use this copy of the software on one computer and reproduce it in the software in a machine readable form for back-up purposes only. You must reproduce the copyright and any other notices of SHARP or its licensors as appropriate , or any other legends that appear on the software, the manual and any packaging, on the copy you have made.
This means that you own the magnetic or other physical media on which the software is originally or subsequently recorded, but SHARP or its licensors retain title and ownership of the material recorded on that physical media irrespective of the form of the media in or on which the original and other copies may be stored. This agreement is not a sale of the original software or any copy of that software. Except to the extent permitted by the Australian copyright law, you may not decompile, disassemble, reverse engineer, copy or modify the software or create derivative works based on the software.
You are not permitted to copy, translate, modify or adapt the accompanying written material or to distribute copies of such material or the software to others. Your failure to abide by these restrictions will constitute copyright infringement and you may be held legally responsible for it to SHARP, or its licensors, as appropriate.
Subject to these restrictions, you are permitted to make reasonable number of copies of the software for back-up purposes as stated above. This software is licensed only to you and may not be transferred to anyone else without the prior written consent of SHARP. Any transferee of the software so authorised shall be bound by the terms and conditions of this agreement and, consequently, you must delete the software from your personal equipment on which it is installed and all program and back-up copies must be handed over to the new user or destroyed.
This agreement will stay in force until terminated. The termination may occur automatically without notice being given to you if you fail to comply with any provisions of this agreement.
Upon termination you must destroy the written materials, program files and back-up copies of the software or return them to SHARP. SHARP warrants that the software will perform substantially in accordance with the accompanying product manuals for a period of ninety 90 days from the date shown on your receipt. SHARP also warrants that the CD-ROM on which the software is stored will be free from defects in material and workmanship under the normal use for a period of one 1 year from the date shown on your receipt.
Any implied warranties as to the software or the storage media are limited to ninety 90 days and one 1 year, respectively, or the shortest period permitted by law whichever is the longer period. If failure in respect of the software or the CD-ROM results from accident, abuse or misappropriation, the Limited Warranty shall not apply. Any replacement software will be warranted by SHARP for the remainder of the original Limited Warranty period but will not be longer than thirty 30 days.
Except as expressly provided in point 7 above and to the maximum extent permitted by law, SHARP excludes all other warranties, either express or implied, including but not limited to implied warranties of satisfactory quality and fitness for the purpose for which the software, the accompanying written materials and any accompanying hardware have been bought.
